Terms and Conditions – Please read before ordering
By placing an order you are agreeing to the terms of this agreement.
This Agreement explains the terms and conditions governing the ordering of the products made available to you by Nikki Wilson T/A SLAP Cosmetics, hereinafter called "SLAP Cosmetics" or "We". It represents the whole agreement and understanding between SLAP Cosmetics and the individual, business, corporation or organization who purchases the products hereinafter called "Customer" or "Customers" or "You" or "you". This document is referred to as the "Agreement".
PLEASE READ THIS AGREEMENT CAREFULLY. By submitting your opening order and by your subsequent ordering, you agree to comply with all of the terms and conditions set out in this Agreement. SLAP Cosmetics may terminate your account(s) at any time, without notice, for conduct that is in breach of this Agreement, or for conduct that SLAP Cosmetics believes is harmful to the business of SLAP Cosmetics or the use of the products by others or is harmful to any other party.
SLAP Cosmetics reserves the right to modify this Agreement at any time, effective upon printing of the modified Agreement on the reverse side of invoices. You are responsible to read this document from time to time to ensure you’re ordering of the products remains in compliance with this Agreement. Subject to the terms and conditions of this Agreement, the Customer agrees to purchase and SLAP Cosmetics agrees to sell the Products identified on the order form and accepted by SLAP Cosmetics.
Notwithstanding, SLAP Cosmetics retains title to the products and all copyrights, trade secret rights, and other intellectual property rights.
1. The customer hereby agrees with SLAP Cosmetics that:-
1.1 The customer must place all orders to SLAP Cosmetics by one of the following options: through the website www.slapcosmetics.com.au or via email to info@slapcosmetics.com.au
1.2 Orders placed with SLAP Cosmetics before 12pm EST will be processed and passed to dispatch upon customer approval and payment and are then subject to the applicable
turnaround times outlined below; orders placed after 12pm EST will automatically be held over until the next business day before being processed and passed to dispatch upon customer approval and payment and are then subject to the applicable turnaround times outlined below
1.3 For orders within Australia, SLAP Cosmetics will accept payment by way of credit cards (Visa, MasterCard) as well as payment via bank transfer and Paypal. For all orders outside of Australia, for countries that SLAP Cosmetics ship to, payment by way of credit card (Visa, Mastercard) will be accepted as well as payment via PayPal
1.4 All prices are subject to change at any time up to the time the order is placed and paid in full.
1.5 The price is exclusive of the cost of the freighting of the Products to the customer and that at the time of the placement of the order for the Products the customer shall pay in addition to the product price and estimation of freight charges, to the price the cost of the delivery of the Products to the customer at the address specified by the customer in the order. Orders will be sent via Australia Post including international orders.
1.6 The customer acknowledges the products ordered are classified as ‘all-natural’ and use minimum preservatives; and as such all products will be stored at 25 degrees or less at all times; SLAP Cosmetics shall not be liable to the customer for any deterioration of any Products not correctly stored whatsoever and howsoever arising; including arising from the shipment of the goods from SLAP Cosmetics to the customer.
1.7 The customer acknowledges the products ordered are classified as ‘all-natural’ and are produced in small batches; as such there may be variances in the product from order to order, the customer acknowledges that these changes are out of the control of SLAP Cosmetics.
2. SLAP Cosmetics hereby agrees with the customer that:-
2.1 All orders placed for the Products shall be delivered by SLAP Cosmetics chosen courier to the customer at the address notified by the customer to SLAP Cosmetics at the time of placement of the order within three business days from the placement and payment of the order, PROVIDED HOWEVER that SLAP Cosmetics shall not be liable to the customer for any delay in the delivery of the Products on any account whatsoever and howsoever arising;
2.2 Immediately upon the Buyer's receipt of any product(s), the Customer shall inspect the same and shall notify SLAP Cosmetics in writing within seven (7) days of any claims for shortages, defects or damages and shall hold the goods for SLAP Cosmetics written instructions concerning disposition; SLAP Cosmetics shall at the sole discretion of SLAP Cosmetics either provide a credit to the customer in respect of any Products that are damaged and returned pursuant to the provisions of this clause or provide replacement Products to the value of the Products that were damaged and returned to SLAP Cosmetics hereunder; If the Customer shall fail to so notify SLAP Cosmetics within seven days after the goods have been received by the Customer, such goods shall be deemed to have been irrevocably accepted by the Customer.
2.3 Any orders placed, approved and paid for by the customer shall be considered final. Order cancellations will not be accepted.
3. The customer hereby agrees with SLAP Cosmetics that the customer shall and does hereby free release and discharge to the extent permitted by law SLAP Cosmetics from and against all claims actions suits or demands arising out of the supply by SLAP Cosmetics to the customer of the Products hereunder and the customer hereby further agrees with SLAP Cosmetics that the customer shall to the extent permitted by law indemnify and keep indemnified SLAP Cosmetics from and against all claims actions suits or demands made against SLAP Cosmetics in respect of the Products or any breach by the customer of the provisions of the within Agreement or on any other account whatsoever which claim action suit or demand may be made by any person or corporation and in respect of personal injury or damage to property.
4. The parties hereto hereby mutually agree that if because of any fact circumstance matter or thing under the control of SLAP Cosmetics that SLAP Cosmetics is unable to perform in whole or in part or is delayed in performing any obligation under this Agreement that SLAP Cosmetics will be relieved of that obligation to the extent and for the period that it is so unable to perform and will not be liable to the other party in respect of such inability.
5. Privacy Policy
5.1 We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998).
5.2 We collect information about you for 2 reasons: firstly, to process your order and second, to provide you with the best possible service.
5.3 We will not e-mail you in the future unless you have given us your consent.
5.4 We will give you the chance to refuse any marketing email from us or from another trader in the future.
5.5 The type of information we will collect about you includes:
* your name
* address
* phone number
* email address
* PayPal Details
5.6 We will never collect sensitive information about you without your consent.
5.7 The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly.
5.8 The personal information which we hold will be held securely in accordance with our internal security policy and the law.
5.9 We do not share your information with parties not associated directly with SLAP Cosmetics or Paypal.
5.10 We may use technology to track the patterns of behaviour of visitors to our site. This can include using a "cookie" which would be stored on your browser. You can usually modify your browser to prevent this happening. The information collected in this way can be used to identify you unless you modify your browser settings.

6. Any contracts or agreements formed between you and us by means of this web site shall be governed and construed according to Australian law, will be deemed to have been made in the State of Victoria, Australia and any disputes or proceedings shall be subject to the exclusive jurisdiction of the Victorian courts.
